Daniel was charged and sentenced to probation which was later dropped due to the COVID-19 pandemic.
I moved to Michigan back in 2015, Daniel has resided with me our entire 8-year relationship. Our relationship started off unstable. We had our child in 2019. I have struggled with sobriety most of my adult life, however; the birth of my daughter motivated me to get sober. The beginning of my sobriety was rocky, but I am proud to say I have over 2 years of sobriety now. Daniel was unable to get sober and showed no motivation. He often blames me for his decision to continue using drugs, and repeatedly tells me he needs the drugs to cope with being around me. I tried to keep the family together, thinking it was the right thing to do for my daughter. However, after years of physical, mental & verbal abuse, paired with a lack of responsibility or respect from Daniel, I decided it was best for my daughter and I to make a home away from Daniel.
During the end of our relationship, I completely shut down socially. I stopped reaching out to my closest friends & became consumed with shame and fear. Within the last few years, Daniel became a frequent user of Methamphetamines. This caused him to get increasingly more violent towards me, and reckless in his care for our daughter. He has not only hurt me in front of Naydia, but he has struck me multiple times while I was carrying my daughter. Whenever I would try to talk to him about drug usage he would become very harsh & manipulative. He fully believes his drug use is my fault because he feels I cast him aside after the birth of our daughter. He has repeatedly told me he would be sober if I were to put my own needs aside so I could keep him occupied physically & satisfy his needs. During that time I didn’t realize it was manipulative & the guilt of letting him down consumed me. I was stripped down physically, emotionally & spiritually until I couldn’t recognize myself anymore. I became extremely depressed.
In late 2019 Daniel sold his house, which Brenda bought, and in turn, Marylin moved into. Daniel’s old house is being rented by his grandmother on behalf of his mother.
When I bought my house on Park Ave, I told Daniel he did not have to move with me if he wanted to stay so close to his family.
since following me to Park Ave, Daniel has very never helped with paying for mortgage, food, utilities, or child care maybe 3 or 5 times in the last 3 years. He had offered numerous times to ask if I needed help, but with our past history of not fulling feeling comfortable on worrying that payments wouldn’t get bounced back. I took full responsibility for trying to figure out bills and house duties myself. Even his new TV was paid for by Marylin, and his car note was signed for by his stepdad.
Not having my biological parents growing up has made me want to try and keep Daniel in my daughter’s life. Just because we couldn’t make it work for the sake of our daughter. His sobriety needs to be taken seriously and the ability to admit and accept one’s actions in hopes of being able to co-parent eventually.
I have been solely responsible for Naydia since her birth because Daniel has never tried. I have done all of her medical visits, insurance payments, and dental. He has refused to work with me on setting a firm routine in order to raise Naydia.
Once Naydia started head start (in the fall of 2022) we both took part in pickups and drop-offs. But as for helping out with her education such as alphabet and numbers, I had taken the responsibility of that since I wasn’t getting the help I needed in order for Naydia to be where she needs to grow.
In 2021 after Daniel lost his job due to his usage of drugs (and amount of call-offs) he stayed home and watched our daughter. I then took on the role of sole provider for our household. His drug usage increased while he was unemployed. I would come home from work to find drug baggies in unsafe places around the house (left out on the floors of the bedroom, in the living room, and between the couches). He always denied knowledge of the paraphernalia when I tried to talk to him about it.
I have pictures of Daniel’s messages to another person saying he has to wait for me to be asleep in order to go pick up the drugs.
I am holding onto hope for a healthy co-parenting relationship between Daniel and me in the future. However, I strongly feel the need for Daniel to complete many intense therapy & show thru time a actions that he is in the right headspace to parent Naydia. I am willing to agree to Indiana guidelines for parenting time once certain tasks have been completed by him. Sobriety is a core value I have for anyone in my daughters life, as well as proper parenting. I left Daniel in hopes of ending a toxic relationship so that he can begin healing. My end goal is shared parenting time, however I do not feel it is the right decision as of now, with the behaviors he has recently shown.
I have tried in 2022 Oct/Nov tried to get Daniel to either attend with me to a couples counseling. I even offered to do a polygraph to make the questions that he hadn’t felt that I was telling the truth or doubted my answer/wasn’t what he wanted/satisfied with the response ( he had declined ), and stated that since I was unfaithful and caused us to be where we are at he wasn’t the problem I was.
From audio and Text messages of him threatening me, reasons why he continued to choose the physical route, exposing my identity on the dark web selling my information, opening a random accounts, and selling my social security number.
Other accounts of abuse have been Daniel throwing an acid chemical on my items. I took my personal documents such as my passport, social security card, and military papers hiding them from me in a storage unit around Nov2022 to use against me. Messages and in-person threats such as the next time he sees me he is going to lay me out, teach me respect, No matter what I do he will find me, even if he goes to jail he knows people who will hurt me, and there are many more in-person threats.
It is my belief his behavior of threatening me and then switching to apologetic behavior is a manipulative tactic he uses to keep me around.
Instead of being able to walk away from Daniel, I was supposed to show respect and that I need to owe up and pay for my actions. It is my understanding that Daniel truly believes he can make a mistake and can get away with anything, but if I make a mistake he can punish me for it however he sees fit.
Due to this I do not belive any saftey from him or his family.
After leaving MY house on Park Ave Daniel sent me a text saying “I’ll just fuck with you financially until you take me serious then.” and a video of water from the upstairs bathroom pouring out of the kitchen ceiling fan. I have completed an insurance claim & a repair crew has came into my house to begin work. He showed up to the house on Park Ave during the first day of their work (violating the currrent PO) and proceeded to show up again the next day. I have both incidents documented and reported with the Mishawaka Police. I would like to return to my home, however; I do not feel safe doing so while Daniel continues to disregard the P.O. and show up to my home & work.
I was unclear of my rights as Naydia’s mother the week after the PO was granted. Which resulted in me agreeing to give Daniel parenting time. However; he quickly betrayed that trust by knowingly taking Naydia to my home on Park AVE while the utilities were turned off. I had to shut them off due to the water damages he caused the week before. He used that situation to blame me, stating i abandoned my family and put Naydia in an unsafe situation by turning off the utilities. This is a prime example of him making decisions and twisting them to make me look terrible. At that time the PO was served: meaning he was not to be at the residence on Park AVE. I have him agreeing to move in with his mother in text. However his actions show me that he never intended to do as agreed. Just another prime example of his words not lining up with his actions.
On April 03 Deputy Brawly helped get Naydia back from Brenda, who told me I would never see my own daughter again. Since then Daniel told me that Brenda fully intends to take custody away from both of us. I fully believe she has always had the end goal of letting us destroy each other until neither of us were fit to raise Naydia. She has been fully aware of our issues and continued to enable her son instead of being a supportive family member. Daniel and his mother have made it very clear over texts that the only way for me to be a mother to Naydia (in their eyes) was to return home to Park Ave, drop the P.O. and give up my hopes of healing myself properly to ensure a bright, happy & healthy future for my daughter. Only a few hours after the Sheriff helped me get Naydia back from her grandmother, her grandmother called CPS and made many absurd claims about my living situation and care of Naydia.
I was told by CPS that the claims against me were that I am running away from my responsibilities and both Daniel and I using cocaine, fleeing to a drug den of users, along beating my own daughter. I took a drug test right then and there. Morgan ( the CPS caseworker) assesed the living situation & has kept in contact with me since then.
Brenda has also forced her way into the house at Sink Road and then texted my friend saying she would call CPS again. With more insults of me telling lies, getting people to feel sorry for me, and claiming once a druggy always a druggy.

Kristina went out to get Taco Bell asked Daniel to watch Naydia roughly 6 months age. After returning Daniel was playing on video game console, Kristina thought he didn’t seem interested in food at the moment. Kristina went outside to power wash porch. Kristina herd Naydia crying in living room were Daniel was as well. She spoke to him asking if he was going to pick up Naydia sense she was crying and asked if he wanted his food. More words were exchanged but cant not recall all the details. Kristina then got the food and dropped it next to him. Daniele then got up very quickly and more words were exchanged, Daniel then proceeds to punch Kristina several times in living room. Kristina ran to kitchen to try and stop the violence, Daniel follows and then grabs a broom to then hit her several times with. Kristina Calls Brenda Daniel’s mom to come over and help get Naydia out of the house. Upon Brenda’s arrival she finds Daniele in garage were they exchanged words. They both then go into the house were words escalated to Daniel hitting Brenda in face knocking off glasses. Kristina called cops, statements were taken and Daniel was arrested. The after course resulted in a cps case witch got resolved, a temporary PO witch then was dropped, Family counseling was provided at the house. Daniel took drug test, and therapy, however the 6 months probation was dropped with all requirements during Covid.

Kristina and Daniel in living room Naydia sleeping upstairs in bed. Kristina and Daniel had been arguing that day and by that night it had not been resolved. Kristina raised voice to make a statement, Daniel grabbed her phone raised his arm and threw phone at Kristina’s face. Kristina blackout for a few seconds and then was unable to see for a few more seconds. Upon regaining conscious and vision Daniel said why did you make me do that go clean your self up. Kristina’s top bridge of nose was poring out blood all over herself and Livingroom. She tried to stop the bleeding and clean up. Daniel then said you need to go to the hospital, he got Naydia and drove them to hospital were to Kristina’s opinion was freaking out saying I don’t want to go to jail what are you going to say to them, Kristina replied with I do not know yet. After receiving medical care the hospital staff ask her what happened, Kristina gave story of falling on ice going up steps. Kristina did not report what had happened do to fear of another cps case being opened, feared Daniel going to jail and causing more retaliation from him lashing out.
Side Note it was at this point Kristina had decided she was no longer in a relationship with Daniel due to the violence getting worse. She decided to start the process of getting out of this situation but feared his retaliation of her safety and the potential of Daniel using their child against her. Going as far as sleeping on the couch instead of a bed in her house.
The Tipping Point

Daniel layed out what he claimed was meth onto an entertainment table and demanded that I take part in it because he never planned on being serious in the relationship and it was about time he ruined my life so that I could never leave him.
I had known about his past and susspected that he was still using, but this was the first time since his parole I saw it in person. Having this in my house, where our daughter lives, was too much.
I agreed, but told him after I get back from buying smokes. I actually used this time to get some space and think about what i could do to get Naydia away from him without getting hurt before I could act.
After “getting smokes” when I got back, an argument began and by the end of the argument I flushed what was supposed to be for me, Daniel said “I still have more” while he went to the master bedroom. I tried to get some sleep on the couch.
Once Daniel left the house some hours later, I decided to actaully try the plan i was still trying to figure out.
Around 1430 without a call, text, or message to anyone I went to the only place I thought would be safe, while I figured out how to move forward and garuntee my daughter and I would no longer be threated or harmed by Daniel again.
Once I talked to Karissa and Nikki, figured out who will sleep where. I got Naydia from Park Ave around 1815 and returned to Sink Road.
Karissa and her family, Ethan and Nikki told me last year that if i ever needed anything, to ask.
I have spent every day since this day at their house, in fear of returning home where Daniel can find us, alone.

Kristina at work received text messages from Daniele stating he was at the Mishawaka house. Daniele puts in message he is going to run up utilities to destroy Kristina Financially. He then sends a video of water pouring through ceiling fan into kitchen. Kristina tells him to leave and that she called the cops. Daniele then states the flooding was an accident he did not know the bathroom drained slow. Kristina and Nichole filed a police report the following day. Kristina has also reached out to insurance to start the claim on extensive repairs.

During call Kristina is holding the phone for Naydia and Brenda then calls Daniel to also talk to Naydia. Kristina stayed quit then part way through call handed the phone to Naydia and walked away. After Daniel hung up Brenda asked Naydia to find her mom so she could talk to her. Nichole also present in living room with them, recorded the majority of call minus the very beginning.

Daniele messaged Kristina wanting to stop by the Dowagiac house to give her money for tire slashing and to not call the cops. Dowagiac house hold not sure how to respond due to the PO in place Kristina did not reply to his message. That day he drove to the Dowagiac house in his car and walked up to the front door waving money in hand. Teresa Newsome Present told him to leave he could not be here. Ethan called 911 to report the PO Violation. Witness Kristina, Karissa, Ethan, Nichole, Naydia, Karissa’s 2 children and Teresa. A police officer came to house and took everyone’s info and statements, Ethan emailed the video from front door camera. Police arrested Daniel that Day and Cass County released on bail same day. We also informed the officer that for Kristina’s safety she has stopped all communication with Daniel and his family to stop the behavior of slander and harassment.
Also to make Daniel aware that all payments of damage will be filed through court hearing.

From the time of Daniel’s release of previous day numerous messages were sent to Kristina’s phone from multiple numbers. Messages varied from accusing of being a bad mom a low life and threats of harm. In the unknown numbers the text states of having to use different numbers to go around the PO and talks about their daughter. Kristina called the Cass police to make a report, the Cass police asked her to read the messages out loud and sent another officer to the Dowagiac house. After another statement and report Daniele was looked for by the Cass police and arrested again when Daniel turned himself in. Cass police added stalking to charges. Daniel was released Tuesday on bail. Witness to messages and reports are the same as April 8th the Dowagiac household.

Around 5pm April 11th Kristina Hart bought all new locks for the Mishawaka House under the knowledge of the PO stating Daniel was effectively evicted from premise and not to trespass. Kristina at work gave Ethan and Nichole Hudson permission to change all the locks on front, rear, and garage door. Ethan & Nichole checking all windows, gates and dog door as locked and secure. Ran into Mike the neighbor two doors down. After a brief summary of situation and explaining of the PO terms Mike stated he would help keep an eye on the house and call if he saw anyone at the house. Two hours later Mike called and informed Ethan that he can see Daniel’s car parked in alley behind house and he was inside Kristina’s house. Kristina and Ethan called the Mishawaka police were they said they would send someone out there. Mike then informed than that Daniel had left and a cop pulled around a minute later.

Kristina, Naydia Ethan & Nichole visited the Mishawaka House to asses and damages and to make report of Daniel’s Previous Break In. Found was the dog door cover on floor of laundry room. Another discovery was a envelope from the Saint Joe Circuit Court that had been opened and contents gone. More finding; the ceiling of kitchen halfway starting to crack and break apart. Pictures were torn up and a frame was broken left on TV stand. Kristina Called Mishawaka police to file findings above. Before leaving the dog door was replaced and washer and dryer were moved in front of dog door wedged between walls. Picture included to show how the door was blocked.

While Kristina was at work in her car Daniel approached her car and tried talking to Kristina. Kristina told him to leave and rolled up her window, Daniel continued to try talking and then hit the window with his hand and left. Attached is the work camera video feed on incident. Kristina did not immediately call police and was also unable to talk about it till following morning. Kristina expressed how the encounter made her feel so unsafe and his controlling aggressive behavior’s will never end. Later Kristina did try to report the incident to Elkhart police and was told it was to late to file sense it was not the same day.

Serve Pro schedule visit to start the inspection of water damage. due to workers going in and out of house the doors were left unlocked. Daniele walked through back door and into living room to Kristina asking questions of what was going on. Kristina asked what are you doing here and then walked out front door to stand on porch. Nichole holding Naydia informed Ethan of his presense. Ethan walked to front door way then Danial walked past him to contunie talking to kristina. Ethan proceeds to call 911. Danial sees Ethan calling police and then tells Kristina your going to let him call the police on me dude I’m going to get a felony. Nichole Procedes to inform him he is breaking the PO he is evicted from this house and is not to be with in 300 feet of her and to leave the property. Daniele states he just wants to see his daughter. Nichole replies with I hear you but you have to wait till the court date. he says goodbye to Naydia and says I’ll see you later today. Danial leaves and a cop comes to the house roughly 10 min later to take statements and says he will file report. officers provides email so videos of cameras of Daniel in house can be submitted. Witness kristina, Ethan, Nichole, Naydia, Serve pro workers. before locking up and leaving the washer and dryer were returned to in front of dog door.
Side note kristina had arranged for her and Naydia to meet with Naydia grandparents at Niles to for Naydia birthday. Kristina Canceled knowing Daniel’s knowledge of meet up.

Cameras from outside had preciously been moved to inside to prevent Daniel’s previous actions of moving and turning off cameras. Kristina’s Camera app notified her of movement and she saw Daniele pushing through the barrier of washer and dryer moving camera up to look twords the ceiling. other camera has him walking through the house looking aroundd, Daniale jumps then runs out of house the way he came. Kristina once again calls the Mishawaka police. Kristina and Ethan are informed of having to file a report at station and then having to go to the house to check for damages. Later Nichole and Naydia join them at the house. Findings are the doog door back side frame had been ripped and broken, the rear gate to alley latched had been forcedly open and bent, and the washer and dryer had been moved. Kristina goes to the store to buy very long screws to close the back yard gate and screwed a board over the dog door cover on the inside of door. An additional camera has been placed outside. The Mishawaka police continue to state the they have to know where he is or to catch him in act to make arrest.

I (Kristina Hart) got out of work early due to light orders, intending to visit my house on Park Ave and make sure it had not been broken into again and potentially meet a friend. While parked at Centeral Park,
While stoped here, instead of the friend appearing as expected, Daniel Paul Harris appeared from the dark and began beating on my car and making demands.
I felt unsafe in this situation and Daniel has a habbit of disappearing before dispatch has completed collecting identity information, so I left and drove to Sink Road Dowagiac MI.
Shortly after leaving Centeral Park, my security system alterted me to a motion event at the house on Park Ave. A figure can be seen in the back yard with a head covering at 2114.
